00 - Definition
This contract governs all orders placed between you and the company Flora Group (hereinafter referred to as Foliflora) as part of its Internet sales system, for all products appearing in the sales catalog of the site https: //www.foliflora.fr. By connecting to this site, you acknowledge having previously read our General Conditions of Sale, accessible by hypertext link, reproducible and storable, and you agree to be bound by them for the purchases of products that you make there.

02 - Purchase and order taking
The site https://www.foliflora.fr contains a commercial proposal for the sale of products, which is not legally considered as a permanent offer.
Your order is definitively recorded once you have validated your payment. The conclusion of the sales contract will only take place if we accept this order. Indeed, we reserve the right not to record a payment and therefore not to confirm an order, in particular for the following reasons: problem concerning the order received (eg abnormal, illegible), delivery requested outside the planned area or risk unpaid.
Once you have validated your payment, you will receive an e-mail from us confirming or denying your order. This e-mail will be sent to you no later than 72 working hours after receipt of this order. The details of your order can be viewed in the confirmation email.

04 - Characteristics of our products
The products we offer on https://www.foliflora.fr are described in the product sheets containing a photo. However, these photographs have no contractual character, Foliflora only making the commitment to deliver a plant or composition of equivalent value to that which has been ordered. The buyer acknowledges and accepts that the bouquet or composition presented on the site represents a unique and artisanal creation, variable according to the artistic sensitivity of the performing florist, and that the delivered bouquet sometimes differs from the aforementioned visual, particularly in terms of presentation. , color or flowers used.
Product offers are valid within the limits of available stocks. In the event of an order confirmed and paid for, and in the event of a stock shortage, Foliflora reserves the right to deliver a product offering identical characteristics in size and quality, having previously notified the customer by telephone or email. .
This guarantee cannot be invoked in the event of delivery carried out with a delay which is attributable to you (incorrect or incomplete address, absent recipient, etc.).
Unlike the photos on the site which show open flowers, we send fresh flowers, sometimes still closed, so that the product blossoms fully in the recipient's home.
Some of our bouquets and floral compositions will be made and delivered by local florists, close to the place of delivery. In this case, the partner florist who will make your bouquet or floral arrangement will do their best to ensure that the bouquet made resembles that of the visual. However, given its supply at the time, the season, and the artistic sensitivity of the florist performing, the bouquet made may be different from that of the photo.
Special Offer - Return of Spring

05 – Payment
Payment is made in cash when the order is taken, by credit card (CB, Visa, Eurocard, Mastercard, etc.) or by Paypal, using SSL secure payment technology.
The debit on the bank card is made in euros only, when we accept your order.
06 – Delivery
The products offered for sale on https://www.foliflora.fr can only be delivered in mainland France, to the address you indicated when placing your order.
Delivery method and times
By validating your order on our site, you accept that Foliflora entrusts the delivery of your order (depending on the delivery time and the product ordered), either to an express carrier chosen by Foliflora, or to a partner artisan florist whose store or the shop is close to the recipient's address.
Deliveries by express transport
Deliveries are ensured in the majority of cases by Chronopost express transport. Details of our delivery services are available on the website https://www.foliflora.fr. Deliveries are made during the day, but foliflora has no commitment when it comes to a specific time or time slot. For the coastal islands, delivery times are not guaranteed and may be extended by one or two working days.
The florist may arrange an appointment by telephone with the recipient of the order in order to make the delivery, but is not obliged to do so. Delivery times are met as precisely as possible. In case of error or omission in the wording of the delivery address preventing its realization as well as in case of refusal of the parcel by the recipient, the delivery will not be less perfect.
You must ensure that the recipient is available on the scheduled day of delivery and do not hesitate to give us as many details as possible that could facilitate the delivery person's task (floor, door code, caretaker, appearance of the place of delivery, terms of access, etc). In case of absence of the recipient, or missing information in the delivery address, the deliverer has no obligation to call the recipient.
However, in the event of the recipient's absence at the time of delivery, the deliverer will identify the best solution to finish the delivery in the best conditions (guardian, neighbour, doorstep, business, etc.), or leave a delivery notice. in the recipient's mailbox, provided that it is accessible and identifiable. The recipient will then have to come and collect his package at the address specified on the delivery notice or in the delivery tracking available on the site.
The withdrawal must then take place within two days due to the perishable nature of the product. If the recipient of the product does not withdraw the product within this period, the sale is no less perfect. In the event of the recipient's absence (or non-response from him/her) when the deliverer arrives, Foliflora cannot be held responsible for the final quality of the delivery.
07 - Option Foliflora "PREMIUM"
Description of the offer
The customer who has subscribed to the FOLIFLORA PREMIUM option benefits from free delivery costs for all orders made on the site and to mainland France (excluding Corsica and Monaco). This option is valid and usable by the customer for a period of one year from the date of subscription. Certain products present on the site may not be eligible for the FOLIFLORA PREMIUM option and in this case will not be able to benefit from free delivery.
Subscription to the offer
FOLIFLORA PREMIUM is reserved for private customers, end consumers, aged 18 and over. To subscribe to FOLIFLORA PREMIUM, the customer must place an order for one or more products on the site and pay the price of the product and the annual subscription fees for the FOLIFLORA PREMIUM option. The terms of payment are indicated on the site and are specified in these general conditions of sale. The amount of the fees for the annual subscription to FOLIFLORA PREMIUM is indicated on the site when ordering. As of its subscription and for a period of one (1) year, the customer will benefit from free delivery.
Conditions of the offer – Termination by FOLIFLORA
To benefit from free delivery costs, the customer must place his orders on the site using his personal email address. The discount on delivery costs will then be automatically applied before he validates the order. No other discount or reduction may be applied when subscribing to the option. The customer undertakes to use his option only for his personal orders and not to offer a third party to use it. The use of the FOLIFLORA PREMIUM option is reserved for individual customers for personal use. In case of suspicion of use of his account by a third party, the customer must inform FOLIFLORA without delay. FOLIFLORA reserves the right to suspend or terminate the FOLIFLORA PREMIUM option in the event of abusive or fraudulent use by the customer or a third party. The customer will be able to contest this decision with FOLIFLORA by sending an email or letter to FOLIFLORA from the contact page of the site. This offer cannot be combined with the loyalty program.
Right to retract
From the subscription to the FOLIFLORA PREMIUM option, the customer has a legal withdrawal period of fourteen (14) days under the conditions provided for in these general conditions. In the event of withdrawal during this period, FOLIFLORA will deduct from the reimbursement the delivery costs corresponding to the free deliveries which the customer will have benefited from with the FOLIFLORA PREMIUM option.
08 – Claim, return and refund
You have 48 clear hours, following the indicative delivery date, to formulate complaints concerning the delivered product.
These complaints must first be the subject of an attempt at amicable resolution. As such, we are committed to doing our best to bring you satisfaction. Under no circumstances can there be damages or interests greater than the amount of the order.
The reimbursement of your order can only take place in the event of non-delivery proven 72 hours after the scheduled delivery date, and for which the fault is not attributable to you. Any refund is made within a maximum period of 21 days if you have paid for your order by credit card or paypal. An e-mail is then sent to you to inform you of the realization of this one.
The buyer has a period of 14 days to exercise his right of withdrawal (excluding perishable products) without having to justify reasons or pay penalties, with the exception, where applicable, of return costs. Any return of goods must be made in its original packaging, the transport costs remaining the responsibility of the buyer.
The period mentioned above runs from the receipt of the flowers or the plant. When the period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.
09 – Force majeure
Foliflora cannot be held liable if non-performance of the contract is delayed or prevented due to cases of force majeure such as war, riot, fire, strikes, accidents, traffic restrictions imposed by the prefectures or the forces of order and the impossibility of obtaining supplies.
Similarly, Foliflora cannot be held responsible for interruptions of the site or intrusion by third parties on the site, valid as a technical event beyond its control and control.
10 – Modification and interruption of service
Foliflora reserves the right to modify or temporarily interrupt all or part of these services for technical or compliance reasons, without notifying the consumer in advance.
11 – Termination for contractual fault of the customer
In the event of non-compliance with these general conditions of sale, Foliflora reserves the right, without any compensation or notice, to suspend or close the user's account and to refuse him future access to all or part of of the service, without prejudice to the various criminal or contractual actions of common law which could be open to him.
