00 - Definition

This contract governs all orders placed between you and the company Flora Group (hereinafter referred to as Foliflora) as part of its Internet sales system, for all products appearing in the sales catalog on the https site: //www.foliflora.fr. By connecting to this site, you acknowledge having previously read our General Conditions of Sale, accessible by hypertext link, reproducible and conservable, and you agree to be bound by them for the purchases of products that you make there.

01 - Applications of the general conditions of sale

You acknowledge having read, by validating your order, the conditions of the offer as defined here. Therefore, they are imposed on you without any reservation. 02 - Purchase and order taking

The site https://www.foliflora.fr contains a commercial proposition for the sale of products, which is not legally considered as a permanent offer.

Your order is definitively registered once you have validated your payment. The conclusion of the sales contract will only take place if we accept this order. Indeed, we reserve the right not to record a payment and therefore not to confirm an order, in particular for the following reasons: problem concerning the order received (eg: abnormal, illegible), delivery requested outside the planned area or risk unpaid.

Once you have validated your payment, you will receive an e-mail from us confirming or denying your order. This e-mail will be sent to you no later than 72 working hours after receipt of this order. The details of your order can be viewed in the confirmation email.

You are responsible for your order. Indeed, the data that you announce to us binds you once the order has been placed. In the event of an error in the wording of the recipient's contact details, we disclaim all liability in the impossibility of fulfilling the order.

03 - Modification or cancellation of an order

You have the option of changing the delivery information or canceling your order as long as it has not yet been prepared. 04 - Characteristics of our products

The products that we offer on https://www.foliflora.fr are described in the product sheets containing a photo and indicating their particularities, the number of stems, as well as the colors of the flowers. However, these photographs have no contractual character, Foliflora only committing to deliver a plant or a composition similar to that which has been ordered.

Product offers are valid while stocks last. In the event of a confirmed and paid order, and in the event of a shortage of stocks, Foliflora reserves the right to deliver a product offering identical characteristics in size and quality, having previously informed the customer by telephone or email. .

This guarantee cannot be invoked in the event of delivery made with a delay which is attributable to you (incorrect or incomplete address, recipient absent, etc.).

Unlike the photos on the site which show open flowers, we send fresh flowers, sometimes still closed, so that the product can fully blossom at the recipient.

Some of our bouquets and floral compositions will be made and delivered by local florists, close to the place of delivery. In this case, the partner florist who will make your bouquet or floral arrangement will do everything possible to ensure that the made bouquet resembles that of the visual. However, taking into account its supply of the moment, the season, and the artistic sensibility of the florist performing, the bouquet produced may be different from that of the photo.

05 - Payment

Payment is made in cash when ordering, by credit card (CB, Visa, Eurocard, Mastercard ...) or by Paypal, using SSL secure payment technology.

The debit on the bank card is done in euros only, when we accept your order.

06 - Delivery

The products offered for sale on https://www.foliflora.fr can be delivered in mainland France only, to the address you indicated when ordering.

Delivery method and times

By validating your order on our site, you agree that Foliflora entrusts the delivery of your order (depending on the delivery time and the product ordered), either to an express carrier chosen by Foliflora, or to a partner florist whose store or the store is close to the recipient's address.

Express transport deliveries

In most cases, deliveries are made by Chronopost express transport. The details of our delivery services are available on the site https://www.foliflora.fr. Deliveries are made during the day, but foliflora has no commitment when to a specific time or time slot. For the coastal islands, delivery times are not guaranteed and may be extended by one or two working days.

Deliveries by a florist

The florist may arrange an appointment by telephone with the recipient of the order in order to make the delivery, but is under no obligation to do so. Deliveries are made during the day by the florist, but he has no commitment when to a specific time or time slot. A minimum period of 4 hours is in this case necessary between the ordering and delivery.

Late delivery

Delivery times are respected as precisely as possible. In the event that a delay in delivery is due to a shortage of stock or to the transport of the products, this cannot give rise to damages and Foliflora cannot be held liable. However, in the case of an express delivery, if the delay exceeds 24 hours, a commercial gesture will be offered to you.

In case of error or omission in the wording of the delivery address preventing its realization as well as in case of refusal of the parcel by the recipient, the delivery will not be less perfect.

You must ensure the good availability of the recipient on the scheduled delivery day and do not hesitate to give us as many indications as possible that could facilitate the delivery person's task (Floor, door code, guard, appearance of the place of delivery, modalities of delivery. 'access, etc.). In the absence of the recipient, or missing information in the delivery address, the delivery person is not obliged to telephone the recipient.

However, if the recipient is absent at the time of delivery, the delivery person will identify the best solution to complete the delivery in the best conditions (guard, neighbor, no door, business, etc.), or leave a calling card. in the recipient's mailbox, provided that it is accessible and identifiable. In the event of the recipient's absence (or no response on his part) when the delivery person passes by, Foliflora cannot be held responsible for the final quality of the delivery.

07 - Foliflora "PREMIUM" option

Description of the offer

The customer who has subscribed to the FOLIFLORA PREMIUM option benefits from free delivery costs for all his orders made on the site and to mainland France (excluding Corsica and Monaco). This option is valid and usable by the customer for a period of one year from the date of subscription. Certain products on the site may not be eligible for the FOLIFLORA PREMIUM option and in this case may not benefit from free delivery.

Subscription to the offer

FOLIFLORA PREMIUM is reserved for private customers, end consumers, aged 18 and over. To subscribe to FOLIFLORA PREMIUM, the customer must place an order for one or more products on the site and pay the price of the product and the annual subscription fees to the FOLIFLORA PREMIUM option. The terms of payment are indicated on the site and are specified in these general conditions of sale. The amount of the annual subscription fee to FOLIFLORA PREMIUM is indicated on the site when ordering. From the date of subscription and for a period of one (1) year, the customer will benefit from free delivery.

Conditions of the offer - Termination by FOLIFLORA

To benefit from free delivery costs, the customer must place orders on the site using his personal email address. The discount on delivery costs will then be automatically applied before he validates the order. No other discount or reduction may be applied when subscribing to the option. The customer agrees to use his option only for his personal orders and not to offer a third party to use it. The use of the FOLIFLORA PREMIUM option is reserved for private customers for personal use. In case of suspicion of use of his account by a third party, the customer must inform FOLIFLORA without delay. FOLIFLORA reserves the right to suspend or terminate the FOLIFLORA PREMIUM option in the event of abusive or fraudulent use by the customer or a third party. The customer will have the possibility to contest this decision with FOLIFLORA by sending an email or a letter to FOLIFLORA from the contact page of the site. This offer cannot be combined with the loyalty program.

Right to retract

From the subscription to the FOLIFLORA PREMIUM option, the customer has a legal withdrawal period of fourteen (14) days under the conditions provided for in these general conditions. In the event of withdrawal during this period, FOLIFLORA will deduct from the reimbursement the delivery costs corresponding to the free deliveries from which the customer has benefited with the FOLIFLORA PREMIUM option.

08 - Complaints, returns and refunds

You benefit from 48 hours, according to the indicative date of delivery envisaged, to formulate complaints concerning the delivered product.

These complaints must first be the subject of an amicable resolution attempt. As such, we are committed to doing our best to bring you satisfaction. Under no circumstances can there be any damages or interest greater than the amount of the order.

The refund of your order can only be made in the event of a proven non-delivery 72 hours after the scheduled delivery date, and for which the fault is not attributable to you. Any refund is made within a maximum period of 21 days if you have paid for your order by credit card or paypal. An e-mail is then sent to you to inform you of the realization of this one.

The buyer has 14 days to exercise his right of withdrawal (excluding perishable products) without having to justify reasons or pay penalties, with the exception, where applicable, of return costs. Any return of merchandise must be made in its original packaging, transport costs remaining the responsibility of the buyer.

The period mentioned above starts from the receipt of the flowers or the plant. When the deadline expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.

09 - Force majeure

Foliflora cannot be held liable if the breach of the contract is delayed or prevented due to force majeure such as war, riot, fire, strikes, accidents, traffic restrictions imposed by the prefectures or the police and the impossibility of being supplied.

Likewise, Foliflora cannot be held responsible for interruptions to the site or intrusion by third parties on the site, which is considered to be a technical event beyond its control and control.

10 - Modification and interruption of service

Foliflora reserves the right to modify or temporarily interrupt all or part of these services for technical or compliance reasons, without first notifying the consumer.

11 - Termination for contractual fault of the customer

In the event of non-compliance with these general conditions of sale, Foliflora reserves the right, without any compensation or notice to suspend or close the user's account and to deny him access to all or part for the future. of the service, without prejudice to the various tort or contractual actions of common law which could be opened to him.

12 - Litigation & Mediation
