00 - Definition
This contract governs all orders placed between you and Flora Group (hereinafter referred to as Foliflora) through its online sales system, for all products listed in the sales catalog on the website https://www.foliflora.fr. By accessing this website, you acknowledge that you have previously read our General Terms and Conditions of Sale, accessible via hyperlink, which are reproducible and storable, and you agree to be bound by them for any product purchases you make there.
01 - Application of the general terms and conditions of sale
By confirming your order, you acknowledge that you have read and understood the terms of the offer as defined herein. These terms and conditions are therefore binding upon you without reservation. Confirming an order on the website signifies your unreserved acceptance of these rules: they are the only terms applicable to the contract thus concluded and supersede all other general terms and conditions, including those of the buyer.
Furthermore, by confirming your order, you acknowledge that you have read not only the information contained in the general terms and conditions of sale of the website https://www.foliflora.fr, but also the following information:

02 - Purchase and order placement
The website https://www.foliflora.fr contains a commercial offer for the sale of products, which is not legally considered a permanent offer.
Your order is definitively registered once you have validated your payment. The sales contract will only be concluded if we accept this order. Indeed, we reserve the right not to register a payment and therefore not to confirm an order, particularly for the following reasons: problem with the order received (e.g., abnormal, illegible), delivery requested outside the designated area, or risk of non-payment.
Once you have confirmed your payment, you will receive an email from us confirming or denying your order. This email will be sent to you no later than 72 business hours after we receive your order. The details of your order can be found in the confirmation email.
You are responsible for your order. The information you provide is binding once the order is placed. In the event of an error in the recipient's contact details, we cannot be held responsible for the inability to fulfill the order.
03 – Order modification or cancellation
You can modify your delivery information or cancel your order as long as it hasn't yet been prepared. After this time, any modification or cancellation of the order by the buyer will be impossible. The order cannot be refunded under any circumstances once the flowers have been delivered.

04 - Characteristics of our products
The products we offer on https://www.foliflora.fr are described in the product pages, which include a photograph. However, these photographs are not contractually binding; Foliflora only guarantees to deliver a plant or arrangement of equivalent value to the one ordered. The buyer acknowledges and accepts that the bouquet or arrangement shown on the website is a unique, handcrafted creation, varying according to the artistic sensibility of the florist, and that the delivered bouquet may differ from the image shown above, particularly in terms of presentation, color, or flowers used.
Product offers are valid while stocks last. In the event of a confirmed and paid order, and in the event of a stock shortage, Foliflora reserves the right to deliver a product offering identical characteristics in size and quality, after having notified the customer beforehand by telephone or email.
This guarantee cannot be invoked in the event of a delivery delay attributable to you (incorrect or incomplete address, absent recipient, etc.).
Unlike the photos on the website which show open flowers, we send fresh flowers, sometimes still closed, so that the product fully blooms at the recipient's home.
Some of our bouquets and floral arrangements will be created and delivered by local florists near the delivery address. In this case, the partner florist who creates your bouquet or floral arrangement will do their best to ensure the finished bouquet resembles the one pictured. However, depending on their current stock, the season, and the florist's artistic style, the finished bouquet may differ slightly from the photo.
Christmas Special Offer
A small poinsettia is offered with every order for deliveries made between December 1st and December 31st, 2022. The color of the container will vary depending on availability. This offer cannot be combined with any other offers on the website, is subject to availability, and is valid only for products with next-day delivery via Chronopost express shipping. This offer is not available for products delivered by local florists or delivered the same day.
05 – Payment
Payment is made in cash when the order is placed, by credit card (CB, Visa, Eurocard, Mastercard...) or by Paypal, using secure SSL payment technology.
The charge to your bank card is made in euros only, when we accept your order.
06 – Delivery
The products offered for sale on https://www.foliflora.fr are deliverable in mainland France only, to the address you provided when placing your order.
Delivery method and times
By validating your order on our site, you agree that Foliflora may entrust the delivery of your order (depending on the delivery time and the product ordered) either to an express carrier chosen by Foliflora, or to a partner artisan florist whose store or shop is close to the recipient's address.
Deliveries via express transport
Deliveries are generally handled by Chronopost express courier. Details of our delivery services are available on our website: https://www.foliflora.fr. Deliveries are made during the day, but Foliflora makes no commitment regarding a specific time or time slot. For coastal islands, delivery times are not guaranteed and may be extended by one or two business days.
Deliveries by a florist
The florist may arrange a delivery appointment by phone with the recipient, but is not obligated to do so. Deliveries are made during the day by the florist, but they are not committed to a specific time or time slot. A minimum of 4 hours is required between placing the order and delivery.
Delivery delay
Delivery times are respected as precisely as possible. In the event that a delivery delay is due to a stock shortage or product transport issues, no compensation will be due, and Foliflora cannot be held liable. However, in the case of express delivery, if the delay exceeds 24 hours, a goodwill gesture will be offered.
In the event of an error or omission in the delivery address wording preventing its completion, as well as in the event of refusal of the package by the recipient, the delivery will nonetheless be perfect.
You must ensure the recipient is available on the scheduled delivery day and provide us with as much information as possible to help the delivery driver (floor, door code, concierge, appearance of the delivery location, access details, etc.). If the recipient is not present or the delivery address is incomplete, the driver is not obligated to call them.
However, if the recipient is not present at the time of delivery, the delivery driver will identify the best solution to complete the delivery under the best possible conditions (concierge, neighbor, doorstep, shop, etc.), or will leave a delivery notice in the recipient's mailbox, provided it is accessible and identifiable. The recipient will then need to collect their package from the address specified on the delivery notice or in the delivery tracking available on the website.
Collection must take place within two days due to the perishable nature of the product. If the recipient fails to collect the product within this timeframe, the sale remains valid. If the recipient is absent (or does not respond) when the delivery person attempts delivery, Foliflora cannot be held responsible for the final quality of the delivery.
07 - Foliflora “PREMIUM” option
Description of the offer
Customers who subscribe to the FOLIFLORA PREMIUM option benefit from free delivery on all orders placed on the website and delivered to mainland France (excluding Corsica and Monaco). This option is valid and usable by the customer for a period of one year from the date of subscription. Some products on the website may not be eligible for the FOLIFLORA PREMIUM option and will therefore not qualify for free delivery.
Subscription to the offer
FOLIFLORA PREMIUM is reserved for individual customers, end consumers, aged 18 and over. To subscribe to FOLIFLORA PREMIUM, the customer must place an order for one or more products on the website and pay the price of the product and the annual subscription fee for the FOLIFLORA PREMIUM option. Payment methods are indicated on the website and are detailed in these terms and conditions of sale. The amount of the annual FOLIFLORA PREMIUM subscription fee is indicated on the website at the time of ordering. From the date of subscription and for a period of one (1) year, the customer will benefit from free delivery.
Terms of the offer – Termination by FOLIFLORA
To benefit from free delivery, customers must place their orders on the website using their personal email address. The delivery discount will then be automatically applied before the order is confirmed. No other discounts or reductions can be applied when subscribing to this option. Customers agree to use this option only for their personal orders and not to allow anyone else to use it. The FOLIFLORA PREMIUM option is reserved for individual customers for personal use. If a third party is suspected of using their account, the customer must inform FOLIFLORA immediately. FOLIFLORA reserves the right to suspend or terminate the FOLIFLORA PREMIUM option in the event of misuse or fraudulent use by the customer or a third party. Customers may contest this decision by contacting FOLIFLORA via email or letter from the website's contact page. This offer cannot be combined with the loyalty program.
Right of withdrawal
Upon subscribing to the FOLIFLORA PREMIUM option, the customer has a statutory right of withdrawal of fourteen (14) days, subject to the conditions set forth in these terms and conditions. If the customer withdraws within this period, FOLIFLORA will deduct from the refund the delivery costs corresponding to any free deliveries the customer received with the FOLIFLORA PREMIUM option.
08 – Claims, returns and refunds
You have 48 clear hours, following the estimated delivery date, to make any claims regarding the delivered product.
These complaints will necessarily be subject to an attempt at amicable resolution beforehand. In this regard, we undertake to do our utmost to ensure your satisfaction. Under no circumstances may damages exceed the amount of the order.
Your order will only be refunded if it is not delivered within 72 hours of the scheduled delivery date, and the non-delivery is not your fault. Refunds are processed within a maximum of 21 days if you paid by credit card or PayPal. You will receive an email notification when your refund is processed.
The buyer has 14 days to exercise their right of withdrawal (excluding perishable goods) without having to provide a reason or pay any penalties, except, where applicable, for return shipping costs. All returned merchandise must be in its original packaging, and the buyer remains responsible for the return shipping costs.
The period mentioned above begins upon receipt of the flowers or plant. When the period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.
09 – Force majeure
Foliflora shall not be liable if the non-performance of the contract is delayed or prevented due to force majeure events such as war, riot, fire, strikes, accidents, traffic restrictions imposed by prefectures or law enforcement and the impossibility of obtaining supplies.
Similarly, Foliflora cannot be held responsible for interruptions to the site or intrusion by third parties on the site, which constitutes a technical event independent of its will and control.
10 – Modification and interruption of service
Foliflora reserves the right to modify or temporarily interrupt all or part of these services for technical or compliance reasons without prior notice to the consumer.
11 – Termination due to breach of contract by the client
In the event of non-compliance with these general terms and conditions of sale, Foliflora reserves the right, without any compensation or notice, to suspend or close the user's account and to refuse them future access to all or part of the service, without prejudice to any other tortious or contractual actions that may be available to it.
12 – Dispute Resolution & Mediation

In accordance with Article L 612-1 of the Consumer Code, the client placing the order has the option of using the CM2C mediation service to which we belong, electronically (www.cm2c.net) or by post (CM2C – 14 rue Saint Jean 75017 Paris).
In accordance with the rules applicable to mediation, any dispute must first be referred to the Customer Relations Department, whose contact details are given in paragraph 1 of these General Terms and Conditions of Sale.
In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has established an Online Dispute Resolution platform, facilitating the independent, out-of-court resolution of online disputes between consumers and businesses in the European Union. 13 – Telephone solicitation opt-out list
In accordance with Article L.223-3 of the Consumer Code, the Customer may object to telephone solicitation by registering free of charge on the BLOCTEL opt-out list on the website www.bloctel.gouv.fr.
14 – Price
The products are supplied at the price in effect at the time the order is placed.
15 – Independence of clauses
If one or more provisions of these terms and conditions are held to be invalid, the other provisions shall remain in full force and effect.
